Our recent BNSL meeting featured a powerful and insightful 10-minute presentation from Manjit Khangura, representing both ELHR Ltd and Well Trade Union. The rising cost of getting employment matters and workplace disputes  wrong

Manjit shared several landmark Tribunal and Employment Appeal Tribunal employment law related outcomes, illustrating how costly mishandled HR and Employment Lawsituations can be:

  • Chagger v Abbey National Plc [2010] a Redundancy & Race discrimination case with large future losses re stigma of returning to industry resulting £2.79 million in remedy.   
  • Dr Eva Michalak v Mid Yorkshire Hospitals NHS Trust (2011)  Sex, Race discrimination and unfair dismissal where tribunal found she would never work again and awarded £4.5 million £4.5 million in compensation.
  • Finn v British Bung Manufacturing Company Ltd anor (2023)  Sexual  Harassment whereby an offensive comment about a man’s baldness by a colleague was construed as Sex-related harassment, employers need to be mindful of the Equality Act 2010 protected characteristics, particularly regarding sex and gender specific physical attributes.
    • Payout was “over £600,000 as compensation for future financial losses” in this case. Because the tribunal judgment itself does not appear the “over £600,000” figure refers specifically to future losses (rather than the total award)

  • Lynskey v Direct Line Insurance  (ET 2023)  a Menopause Disability Discrimination case whereby reasonable adjustments s.20 Equality Act 2010 were not undertaken by the employer and the employee won £65,000 after failure to adjust their performance management processes.

 Average awards currently stand at approximately:

    • £45,435 — Disability Discrimination
    • £23,070 — Race Discrimination

These examples reinforced Manjit’s core message:
